Continue ShoppingAgreement version SM-ART-2026-10-27-v1
Keep this version with your order confirmation. Only the license selected in your order applies.
The Artist is the legal seller identified in the order confirmation, trading as StyleMechanics or thestylemechanic. The Client is the person or business named in the order. This agreement consists of the confirmed project schedule, these service terms, and the selected Personal, Business Branding, or Merchandise license. Changes to rights or deliverables require written agreement by both parties; a specific signed change takes priority over a general term. No new charge or broader obligation may be added after purchase without the Client’s agreement.
The confirmed order identifies the text, designs, colors, dimensions, delivery, revisions, fee and estimated completion date. Personal digital delivery includes finished JPEGs. Business delivery includes print-ready TIFF, PDF or another agreed high-quality format. Editable layers, Procreate, PSD, SVG, vectors and font files are excluded unless listed. Files are emailed after completion, not downloaded instantly. Signed originals include a certificate of authenticity and final digital artwork; shipping is added before payment. Personal paper originals use the displayed personal rates, are unframed and up to 9×12 inches, and include a JPEG. Three handstyles are on one sheet. Larger work requires a separate quote. Personal originals grant personal use only. Digital-only and sticker prices do not include an original.
Payment is due as shown before checkout or in the accepted quote. No additional fees are due without prior written approval. A license begins only when the agreed fee is paid in full and the Artist delivers the identified final artwork with written confirmation of its permitted use. Previews, rejected designs and unfinished concepts may be reviewed but may not be published, reproduced commercially or sent into production. A client account or quotation alone grants no usage permission.
Business packages include one revision round per included final design, unless the confirmed order states otherwise. A revision round is one consolidated list of reasonable changes within the original brief. Personal revisions are included only if expressly listed before payment. Extra concepts, a new name or brief, further revisions and later production changes require a separate agreed price. The Client checks spelling, colors, dimensions and intended use before approving the proof in writing. Approval does not waive a right to correction when the delivered files differ from the approved proof. Silence is not approval.
The delivery estimate starts after the Artist receives the agreed payment and a complete brief. Client delays in providing information or approval move the estimate by a reasonable corresponding period; the Artist will communicate a revised date. For paper orders, agree the paper size, number of sheets and whether the physical original replaces or accompanies digital files before payment. Shipping cost, destination, tracking where available and estimated dispatch must be disclosed. Report loss or damage promptly with available photos; the parties will work toward a suitable replacement, correction or refund as applicable. Mandatory delivery and consumer rights remain unaffected.
The Client may cancel by written notice. Before work starts, the Artist refunds payments less any separately disclosed, approved and nonrecoverable outside costs, to the extent permitted by law. After work starts, the Artist may retain only a reasonable amount for documented work completed within the agreed scope and those approved outside costs, capped at the amount paid; the unearned balance is refunded. If the Artist cancels or cannot complete the order, unearned fees and amounts paid for undelivered work are refunded. Errors caused by the Artist are corrected without an extra art fee. No term removes a remedy required by law.
The Artist retains copyright in protectable original contributions except for an express separate signed transfer. These licenses grant use permission, not ownership or automatic exclusivity. A paper original does not transfer reproduction rights. Names, short phrases, lettering styles and very simple designs may not qualify for copyright protection; this agreement does not claim ownership of them or restrict rights that applicable law leaves with the Client. The Client retains rights in its own names, trademarks and supplied materials. Each party is responsible for having permission to supply or license the material it contributes. Trademark searches, registration and legal clearance are not included; the Client should obtain its own clearance before adopting a mark.
The Artist may show completed client artwork in a portfolio, stream or social post only if the Client separately opts in or later gives written permission. Portfolio permission is optional and does not affect the package price. Do not publish private contact details, project briefs or unreleased business information without separate permission. Account creation and agreement acceptance do not subscribe the Client to marketing.
New products, additional brands, extra quantities, new territories, extended terms or other use beyond the chosen license require a written amendment and agreed fee before that use begins. For a suspected breach, the affected party will identify the issue in writing and allow 14 days to address it where reasonably curable. The Artist may suspend the affected permission for an unresolved material breach after notice, subject to applicable law; neither party gives up legally available remedies. Parties will first try to resolve order disputes directly. Florida law governs to the extent permitted, without displacing mandatory consumer protections or applicable federal law. No mandatory arbitration, automatic penalty or waiver of statutory rights is included.
The Client must be an adult able to contract, or a parent or guardian must place the order. A business signer confirms authority to act for the named business. Both parties may agree electronically and must be able to retain the terms and completed schedule. Preserve the exact agreement version and acceptance record with the order and email a copy to the Client. A website checkbox is an acceptance step, not a promise that every contract will be enforceable. Any required legal consent to electronic delivery must also be obtained.
After payment and final delivery, the Artist gives the Client and a named gift recipient a nonexclusive, worldwide permission, with no scheduled end date, to keep the delivered final JPEGs, display them personally, share them on noncommercial personal social profiles and make personal prints or gifts that are not sold. A printing service may receive a file solely to fulfill those permitted personal prints; it receives no right to keep using or reselling the artwork.
This purchase does not permit business branding, paid advertising, product packaging, merchandise for sale, licensing to other businesses, sale of the digital files, stock assets, templates or font products. Obtain a Business Branding or Merchandise agreement before that use. The restriction concerns the commissioned artwork and agreed use, not ownership of the Client’s name or a graffiti style.
Only the paper size, sheet count and originals listed in the order are included. Shipping and any paper upgrade are disclosed before purchase. Personal digital files are finished JPEGs, not editable masters. Owning or gifting the physical original does not expand the permitted reproduction use. A lawful transfer of the physical original does not by itself assign copyright.
Tag Pack, Name Pack, Full Style Pack, Collector Pack and individual styles selected for personal use. Collector Pack includes one signed original throwie up to 9×12 inches, a certificate of authenticity, emailed JPEG and the selected included kiss-cut stickers. Shipping is extra. The confirmed order controls the designs and delivery. Canvas commissions follow the selected canvas dimensions and confirmed scope; the 9×12-inch paper limit does not apply to canvas. Canvas prices include a signed original, certificate, emailed photo and one sketch revision before painting. Commercial reproduction is excluded.
After payment and final delivery, the Artist grants the named business a nonexclusive, worldwide, royalty-free license, with no scheduled end date, to use the approved final artwork as its business identifier and on its own website, social profiles, business stationery, service signs, advertising and packaging for its own goods. Permission covers only the named business and the specific final artwork identified in the schedule.
This branding license does not permit selling apparel, stickers, prints or other goods whose offered design is the artwork, reselling the digital artwork or licensing it to another brand. Packaging that identifies the Client’s own goods is allowed; selling printed artwork as a product requires the Merchandise license. Employees, agencies and printers may handle the files solely to perform the Client’s permitted uses, with no independent reuse rights.
The Client may resize the artwork proportionally and make necessary technical file conversions. Material redesigns and new versions require agreement. The Artist will not supply the same final commissioned logo as another business’s identifier. This is a contractual promise, not an exclusive copyright assignment. The Client retains its own trademark rights, subject to applicable law; the Artist does not guarantee trademark availability, registration or exclusivity of ordinary names, styles or letterforms.
Business Starter Pack, Signature Pack and Brand Pack, plus individually quoted branding projects, include only the designs listed in the confirmed order, print-ready TIFF, PDF or another agreed high-quality format, and one revision round per included final design unless otherwise agreed. File dimensions and print needs are confirmed before work. Source files, vectors, font development and ownership buyouts require separate agreement. Business Starter Pack also includes a signed unframed paper original up to 9×12 inches, certificate and the selected kiss-cut sticker format. Shipping is extra.
After payment, approval of the completed merchandise schedule by both parties and final delivery, the Artist grants the named business a nonexclusive, royalty-free license to reproduce the identified final artwork on the specified product types, sell those authorized units through the specified channels and advertise those products within the agreed territory and term. No merchandise production is permitted while the product types, unit cap, territory or term remain unspecified.
The schedule states an aggregate production cap and, if needed, separate caps by product. Count all manufactured units bearing the artwork, including giveaway and promotional units; sizes and colors do not create a new allowance. Manufacturing overruns require written approval before manufacture. Keep reasonable production records and provide a relevant count on a reasonable request. No automatic audit, access to unrelated business records or extra fee is created by this clause.
State an end date or expressly agree that there is no scheduled end date. State a sell-through end date or expressly agree none is needed. After the production term ends, no new units may be made; existing authorized stock may be sold only during the agreed sell-through period. A higher quantity, different product, new brand, added territory, new channel or extended period requires a written amendment and agreed fee before the expanded use. No renewal or royalty is charged automatically.
The Client may give final files to its printer or manufacturer only to produce the permitted units. Vendors receive no independent right to reuse, sell or distribute the files. The Client remains responsible for communicating the agreed limits to vendors. Digital asset resale, sublicensing, stock libraries, fonts, templates and uses not named in the schedule are excluded. Scaling and technical print preparation are allowed; a material redesign requires approval. The Artist retains protectable copyright; source files, vector files, exclusivity and ownership transfer are not included.
The Client checks the manufacturer’s proof or sample before authorizing a run. The Artist supplies files to the agreed specifications and corrects its own file errors; manufacturing services, physical product quality and printer charges are not included unless separately quoted. The permitted merchandise uses do not grant additional branding rights unless the schedule expressly includes the Business Branding license.
